TERMS AND CONDITIONS (Temporary Event Hire)

1 Definitions:

1.1 The “Client” is defined as the person/s or company booking the equipment with the “Company”.

1.2 The “Company” is defined as SFX Games trading under Everything Goes Bang Ltd.

2 Bookings, Deposits & Payments:

2.1 All bookings are secured by a deposit of 50%. This deposit is non-refundable.

2.2 All remaining balances must be paid in full and cleared 14 days prior to event date.

2.3 By booking an order with us, either verbally or by email, regardless of whether a deposit has been paid or booking form completed, the Client has read, understood and fully agrees to all our terms and conditions of hire.

2.4 In the event of circumstances out of our control, for example but not limited to: weather, traffic, or act of god, or that which prevents us from fulfilling our contractual obligation, our liability will be limited to a refund of the hire fee, or a pro rata reduction in hire fee in the event of a delayed start. No other compensation will be made, regardless of any loss of earnings.

2.5 Game hire prices are subject to change without prior notification.

2.6 All prices are subject to VAT.

2.7 All equipment is on a hire basis only and remains the property of the Company at all times.

3 Cancellations:

3.1 All cancelled orders are subject to the following cancellation charges:

Within 6 weeks prior to event: 50% of order value.

Within 4 weeks prior to event 75% of order value.

Within 2 weeks prior to event 100% of order value.

3.2 Under no circumstances will the Company accept any cancellation due to weather conditions. 100% of cancelation fee will apply should the Client wish to cancel due to any weather conditions.

4 Equipment:

4.1 The Company reserves the right to substitute without notice, any hired equipment with another suitable substitute in the event of breakages or damages relating to current or previous hire.

5 Site Location & Facilities:

5.1 Hired equipment will be unloaded and set up in one location, as per agreed on arrival, and not be moved afterwards.

5.2 The Company reserve the right to refuse delivery of equipment if the site is deemed not accessible or suitable, or if the client has failed to inform Company of obstacles, for example but not limited to: rocks, cliffs, uneven terrain, staircases or other such obstructions, including long distances from loading vehicles. No refund will be given and 100% of hire fee will be due.

5.3 The Client must provide suitable power agreed upon prior to event. The Company reserve the right to refuse delivery if suitable power is not provided to enable games to function. No refund will be given and 100% of the hire fee will be due.

5.4 The Client must provide suitable access to toilets for Company employees.

6 Conduct:

6.1 The Company reserves the right to cease operations and remove hire equipment from site immediately if any of the Company’s employees feel the Clients or guests of the Clients are deemed too intoxicated, abusive, or a danger to themselves or any of the hire equipment. No refund will be given and 100% of the hire fee will be due.

6.2 The Client is responsible for crowd control measures and suitable security are provided for the entire event.

7 Insurance and Liability:

7.1 Clients must have read and agreed in full to relevant risk assessments associated to specific game hire.

7.2 The Client agrees to indemnify the Company for any damage or theft of Company’s equipment whilst on hire. 

7.3 The Company accept no liability whatsoever for any damage or loss of personal property, or any injury arising from the use of hired equipment and/or games.

PLEASE DO NOT BOOK WITH SFX GAMES or EVERYTHING GOES BANG LTD UNLESS YOU AGREE TO 100% OF THESE TERMS AND CONDITIONS.
